Terms of Service

1. Introduction

These terms govern your use of the DataScene Tenders service provided by Datascene Limited ("we", "us", "our"), a company registered in England & Wales (company no. 03602993, VAT registration no. GB 715 1117 75). By creating an account or using the service you agree to these terms. If you are agreeing on behalf of an organisation, you confirm you are authorised to bind that organisation.

2. The service

DataScene Tenders aggregates publicly available UK and European public-sector tender and contract-award information and provides search, alerting, AI-assisted analysis and bid-management tools.

Accuracy of the information we display. The tender, contract-award, buyer, pipeline and spend information in the service is gathered from procurement notices and other feeds published by contracting authorities and third parties. We take reasonable care to collect, de-duplicate, normalise and present that information as accurately and as current as we can — but we do not originate it, and we cannot guarantee that it is accurate, complete or up to date. Source notices are routinely incomplete, mis-categorised, amended or withdrawn after publication, and upstream feeds may be delayed, changed or discontinued without notice. The service is provided for information only and is not professional, legal or procurement advice.

You are responsible for verifying any opportunity against the official notice before relying on it or submitting a bid. To the fullest extent permitted by law, we are not responsible or liable for any error, omission, delay or inaccuracy in the information displayed, nor for any decision, bid, cost or loss arising from your reliance on it. See also section 12 (Liability).

3. Accounts & eligibility

• You must provide accurate registration details and keep your credentials secure.
• You are responsible for all activity under your account, including that of users you invite to your workspace.
• You must be at least 18 and using the service for business purposes.
• Notify us promptly of any unauthorised access at security@datascene-tenders.co.uk.

4. Acceptable use

You agree not to:

• scrape, bulk-export or resell the data other than as the service permits;
• attempt to disrupt, reverse-engineer, or gain unauthorised access to the service or its infrastructure;
• upload unlawful content or anything you do not have the right to share;
• use the service to send unsolicited communications or to infringe others' rights.

5. Trials, subscriptions & billing

We may offer a free trial. After any trial, continued use requires a paid subscription at the price shown on our pricing page. Fees are billed annually in advance and are non-refundable except where required by law. We will give reasonable notice of price changes. You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.

Card details. We do not collect, process or store payment card details on our systems. Card payments are taken by our payment provider through their own secure hosted checkout — your card details are entered with them and never reach us. We hold only the billing information needed to manage your subscription and issue invoices (such as your company name, billing address and a record that a payment succeeded).

AI credits. Some AI features draw on an allowance included in your subscription, which resets each billing month and does not roll over. Where we offer additional AI credits for purchase ("top-ups"), those credits are added to a separate balance that does roll over and does not expire while your subscription is active. Purchased credits are non-refundable, have no cash value, and cannot be exchanged or transferred; any unused balance is forfeited if your subscription ends, lapses or is terminated. Renewing before your subscription ends keeps your balance: it carries over into the new term.

6. Your content

You retain ownership of the company profiles, documents, bid records and other content you put into the service ("your content"). You grant us a limited licence to host and process your content solely to provide the service. We handle personal data in line with our Privacy Notice.

7. Data protection & your data

We process personal data in line with our Privacy Notice and applicable UK data protection law (UK GDPR and the Data Protection Act 2018).

Exporting your data. You can export your data at any time from your account settings. The export is a machine-readable JSON file containing your profile and workspace, saved searches, bookmarks, bids and bid comments, bid-library entries, tracked companies, shared opportunities, notification channels, scheduled reports, API tokens and the audit-log entries about you. Tender and award data can also be exported to CSV from the listings, or read via the API. For security we exclude credentials and cryptographic material (such as password hashes and encrypted secrets) — those are operational state, not your data.

Deleting your account. You can delete your account at any time from your account settings. Deletion is immediate and irreversible: we remove your personal data and your content, and where you are the last remaining member of a workspace we remove the workspace too. We keep an anonymised audit record that an account was deleted, and we may retain a limited amount of information where we must do so to meet a legal, tax or security obligation, or to establish or defend legal claims. Public procurement information is unaffected — it is not personal data about you.

8. Our intellectual property

The service, its software, design and branding are owned by us or our licensors. These terms do not transfer any of those rights to you beyond the right to use the service as permitted here.

9. Public-sector data & licensing

The tender, contract-award, buyer and spend information in the service is derived from publicly available procurement information published by contracting authorities. We aggregate, de-duplicate, normalise, enrich and analyse that information; our compilation, scoring, analysis and presentation are our intellectual property, while the underlying public-sector records remain subject to the licences set out below.

This service contains public sector information licensed under the Open Government Licence v3.0, and/or information from the EU Tenders Electronic Daily website licensed for re-use by the European Commission. Public-sector information is © Crown copyright or © European Union as applicable.

Public-sector information is provided to you as published by the relevant authority. While we take care over ingestion and normalisation, we do not warrant that it is accurate, complete or current — see section 2. Always verify an opportunity against the official notice before relying on it.

10. AI-assisted features

Some features use AI to generate drafts, summaries and analysis. AI output can be inaccurate or incomplete and must be reviewed before you rely on it. You are responsible for the content of any bid or submission you make.

11. Availability

We work to keep the service available but do not guarantee uninterrupted access. We may carry out maintenance, and may modify or discontinue features with reasonable notice. We do not offer a contractual uptime service level.

12. Liability

Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud). To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, business, or anticipated savings, or for any procurement decision you make using the service. Our total liability in any 12-month period is limited to the total fees you paid to us in that period.

13. Termination

You may close your account at any time. We may suspend or terminate access if you breach these terms or fail to pay. On termination your right to use the service ends; we handle your data as set out in the Privacy Notice.

14. Governing law

These terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction.
